Welcome to FlexCal. By downloading, installing, or using the FlexCal app ("the App"), you agree to the following Terms of Service ("Terms"). Please read them carefully before using the App.

1. Acceptance of Terms

By accessing or using FlexCal, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App. We reserve the right to update these Terms at any time, and your continued use of the App after any changes constitutes acceptance of the revised Terms.

2. Description of Service

FlexCal is a calendar and appointment scheduling app designed for service-based businesses. The App allows you to create custom event types, design appointment forms, manage staff assignments, schedule appointments, and sync data across your devices via Apple iCloud. FlexCal is available on iPad and iPhone running iOS 17 or later.

3. Subscriptions and Pricing

FlexCal offers the following subscription plans:

A 7-day free trial is included with your first subscription. You will not be charged during the trial period. If you do not cancel before the trial ends, your subscription will automatically begin and you will be charged the applicable subscription fee.

4. Billing and Auto-Renewal

Subscriptions are billed through your Apple ID and are managed entirely by Apple. Your subscription will automatically renew at the end of each billing period unless you cancel at least 24 hours before the end of the current period. You can manage or cancel your subscription at any time through your device's Settings > Apple ID > Subscriptions.

Prices are in U.S. dollars and may vary by region based on App Store pricing. Apple may adjust prices in accordance with their policies.

5. Free Trial

New users are eligible for a 7-day free trial. The trial provides full access to all features of the App. If you cancel during the trial period, you will not be charged. Only one free trial is available per Apple ID.

6. View Only Mode

If your subscription expires or is not renewed, the App will switch to View Only mode. In View Only mode, you can continue to view all of your existing appointments and data, but you will not be able to create new events, edit existing events, or modify your configuration. Your data remains safe on your device and in iCloud and will be fully accessible again once you resubscribe.

7. Refunds

All purchases and subscriptions are processed by Apple. Refund requests must be submitted through Apple. You can request a refund by visiting reportaproblem.apple.com or contacting Apple Support. We do not process refunds directly.

8. Your Data and Responsibilities

You are solely responsible for the data you enter into FlexCal, including customer names, addresses, phone numbers, and any other information collected through your custom appointment forms. You agree to:

All data is stored locally on your device and, if enabled, synced via Apple's iCloud service. We do not collect, access, or store your data on any external server. For full details on how your data is handled, please review our Privacy Policy.

10. Intellectual Property

FlexCal and all associated content, features, and functionality — including but not limited to the app design, code, graphics, and user interface — are owned by FlexCal and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of the App.

11. Disclaimer of Warranties

FlexCal is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. We do not warrant that the App will be uninterrupted, error-free, or free of harmful components. We make no guarantees regarding the accuracy, reliability, or availability of the App or its features, including iCloud synchronization.

12. Limitation of Liability

To the maximum extent permitted by applicable law, FlexCal and its developer shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of revenue, or business interruption, arising from your use of or inability to use the App. Our total liability shall not exceed the amount you paid for the App in the 12 months preceding the claim.

13. Indemnification

You agree to indemnify, defend, and hold harmless FlexCal and its developer from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from your use of the App, your violation of these Terms, or your violation of any rights of a third party.

14. Termination

We reserve the right to suspend or terminate your access to the App at any time, with or without cause and with or without notice. Upon termination, your right to use the App will immediately cease. Provisions regarding data ownership, limitation of liability, and indemnification shall survive termination.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Georgia, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the App shall be resolved in the courts of the State of Georgia.

16. Changes to These Terms

We may revise these Terms from time to time. Any changes will be posted on this page with an updated effective date. Your continued use of the App after changes are posted constitutes acceptance of the revised Terms.
